Lumail Terms of Service (TOS)

Overview

This website and application ("Lumail", the "Service") is operated by Codelynx, LLC, a U.S. company registered in Delaware. Throughout these Terms of Service, "we", "us", and "our" refer to Codelynx, LLC. By accessing or using Lumail.io, you agree to be bound by these Terms of Service and our Privacy Policy.

Lumail is an email marketing and delivery platform that allows organizations to send transactional and marketing emails to subscribers. By using Lumail, you agree to comply with all applicable laws and the policies outlined below.

1. Use of Service

To access Lumail and send emails, you must:

  • Verify your organization through our manual review process
  • Add and configure your own domain, with SPF/DKIM/DMARC records
  • Agree to rate limits and delivery limits imposed by your plan

For testing purposes, users may temporarily use our shared subdomain send.lumail.io, subject to stricter rate limits.

2. Compliance and Consent

  • Unsubscribe links are mandatory in every email you send
  • Double opt-in is optional but recommended
  • You must only email users who have explicitly opted in
  • You may not upload purchased, scraped, or third-party lists

3. Email Deliverability and Abuse

We actively monitor:

  • Spam complaint rate
  • Bounce rate
  • Unsubscribe rate

Accounts that exceed industry-standard thresholds may be suspended without notice. Permanent bans apply to organizations or users who:

  • Send unsolicited email
  • Circumvent unsubscribe logic
  • Repeatedly exceed bounce/complaint limits

4. Bounce and Complaint Handling

Lumail uses automated systems to handle bounces and complaints:

  • A bounced or spam-complained email address is permanently suppressed
  • These addresses can no longer be targeted from your account

5. Domain and DNS Configuration

All users must:

  • Verify their sending domain via DNS (SPF, DKIM, DMARC)
  • Complete all domain setup before sending
  • Be responsible for their DNS propagation and accuracy

Lumail does not provide DNS management or proxy configuration.

6. Data Storage and Infrastructure

Lumail is hosted entirely in the United States. Infrastructure includes:

  • Vercel (application hosting)
  • Neon.tech (PostgreSQL database)
  • Upstash (Redis queues)
  • Inngest (background jobs, automation)

7. Prohibited Activities

You may not use Lumail to:

  • Send spam, phishing, or illegal content
  • Bypass unsubscribe functionality
  • Upload non-consensual email lists
  • Misrepresent your sender identity or email content

Violations will result in immediate account suspension and potential legal action.

8. Limitation of Liability

The service is provided "as is" without warranty. We are not liable for:

  • Lost profits or revenue
  • Delivery failures due to incorrect DNS
  • Email blacklisting or spam placement
  • Actions taken by Amazon SES or third-party providers

9. Governing Law

These terms are governed by the laws of the State of Delaware, United States.
